Will my case go to trial if I hire an attorney?

Many people are apprehensive to hire an attorney for their personal injury claim because they do not want to go to trial.  This apprehension, however, can significantly reduce your overall recovery.

Often after an injury, you will likely be contacted by an insurance adjuster asking about your injuries, and at the end of this conversation, you might even be offered a sum of money to compensate you for your claims.  Unfortunately, this is a common insurance tactic to induce you into a low-ball settlement for your injuries.  Insurance companies do not have your best interest at heart—they care about their own financial interests and their bottom line.

After an injury, it is important to contact an attorney as soon as it is safe to do so.  While attorneys, especially trial lawyers, begin preparing for trial on day-one, trial is not always a guaranteed outcome if you hire an attorney.  A well-qualified and experienced personal injury attorney knows and understands that trial is a long and emotional process for a victim to endure.  As such, a good-faith effort is made to resolve your claim prior to trial.

Once you have retained an attorney, your counsel will send a notice of representation to the party who injured you or their insurance company.  This lets the insurance company know that you are taking this matter serious and that you will not be bullied into a settlement which is not in your best interest.  If unable to resolve your claim at this stage, a personal injury lawsuit will be filed on your behalf against the person responsible for your injuries.  While the filing of a lawsuit sets your case on the path to a trial, there is still a chance to resolve your claim prior to trial.   Resolution of your claim prior to trial can occur through informal negotiations with the defendant or through a more formal mediation.
